1. Introduction

These Terms and Conditions govern your use of the Rare Ritual Labs website (www.rareritual.co.za) and your purchase of products from us. By browsing our website or placing an order, you agree to be bound by these terms.

Please read these terms carefully before using our website or making a purchase. If you do not agree to these terms, you should not use our website or purchase our products.

Rare Ritual Labs reserves the right to update these terms at any time. The version in effect at the time you place an order will apply to that order.

2. Definitions

In these Terms and Conditions:

  1. "Rare Ritual Labs", "we", "us", and "our" refers to Rare Ritual Labs, the operator of www.rareritual.co.za
  2. "You" and "your" refers to the person using our website or purchasing our products
  3. "Products" refers to the skincare formulations and any other goods listed on our website
  4. "Order" refers to a purchase of one or more products submitted through our website
  5. "CPA" refers to the Consumer Protection Act 68 of 2008 of South Africa

3. Eligibility

By using our website and placing an order, you confirm that:

  1. You are at least 18 years of age
  2. You are legally capable of entering into a binding contract
  3. You are using our website for personal, non-commercial purposes unless otherwise agreed in writing

4. Products

4.1 Product descriptions

We take care to describe our products accurately. However, slight variations in colour, texture, and scent may occur between batches due to the natural origin of many of our ingredients. These variations do not constitute defects and do not affect product performance.

Product images on our website are for illustrative purposes. While we do our best to display products accurately, your screen's colour settings may affect how images appear.

4.2 Pricing

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. We reserve the right to change prices at any time without notice. The price applicable to your order is the price displayed at the time you complete your purchase.

In the unlikely event of a pricing error on our website, we will contact you before processing your order to confirm the correct price. You will have the option to proceed at the correct price or cancel your order.

4.3 Availability

All products are subject to availability. If a product is out of stock after you have placed your order, we will notify you as soon as possible and offer a refund or, where possible, an alternative product or estimated restock date.

5. Orders and Payment

5.1 Placing an order

When you place an order on our website, you are making an offer to purchase the selected products at the stated price. We reserve the right to accept or decline any order for any reason.

You will receive an automated order confirmation email once your order has been received. This confirmation does not constitute acceptance of your order. Acceptance occurs when your payment has been processed and your order has been dispatched.

5.2 Payment

We accept the payment methods listed on our website at the time of checkout. Payment is required in full at the time of ordering.

All transactions are processed securely through our payment provider. We do not store your card details. By providing your payment details, you confirm that you are authorised to use the payment method.

5.3 Order cancellations

Once an order has been placed and payment processed, we cannot guarantee that it can be cancelled or amended. If you need to make a change, please contact us at shop@rareritual.co.za as soon as possible. If the order has already been dispatched, you will need to follow our Returns Policy.

6. Delivery

6.1 Delivery area

We currently deliver within South Africa only. We do not offer international shipping at this time.

6.2 Delivery timeframes

We aim to dispatch orders within 2 to 3 business days of payment being confirmed. Estimated delivery times after dispatch are typically 3 to 5 business days for standard delivery, depending on your location. Remote areas may take longer.

Delivery timeframes are estimates only. We are not liable for delays caused by couriers, circumstances outside our control, or incomplete delivery address information provided by you.

6.3 Delivery costs

Delivery is charged at a flat rate shown at checkout, currently R50 per order within South Africa. Free delivery is offered on orders above the threshold displayed on our website at the time of ordering (currently R650). Both the delivery rate and the threshold may change from time to time.

6.4 Risk and ownership

Risk of loss or damage to products passes to you upon delivery. Ownership of the products passes to you once we have received full payment.

6.5 Failed delivery

If a delivery attempt fails due to an incorrect address, the recipient not being available, or any other reason attributable to you, re-delivery costs may be charged. If the product is returned to us, we will contact you to arrange redelivery or issue a refund less the original delivery cost.

7. Returns and Refunds

Our Returns Policy forms part of these Terms and Conditions. Please refer to our Returns Policy document for full details on how to return a product and the circumstances in which refunds or exchanges are offered.

8. Consumer Protection Act

These Terms and Conditions are subject to the Consumer Protection Act 68 of 2008 (CPA). Where any term conflicts with a provision of the CPA that cannot be excluded by agreement, the CPA provision will apply.

Your rights under the CPA include:

  1. The right to fair and honest dealing
  2. The right to disclosure of information
  3. The right to safe and quality goods
  4. The right to return defective goods
  5. The right to cancel certain agreements within a cooling-off period

Nothing in these Terms and Conditions is intended to limit or exclude any right you have under the CPA.

9. Product Use and Safety

Our products are cosmetics intended for external use only. Always read the product label and directions before use.

  1. Conduct a patch test before first use, particularly if you have sensitive skin or known allergies
  2. Discontinue use and consult a healthcare professional if irritation or adverse reaction occurs
  3. Keep products out of reach of children
  4. Store products as directed on the label

Rare Ritual Labs cannot be held liable for adverse reactions resulting from failure to follow product instructions or from pre-existing skin conditions not disclosed to us.

10. Intellectual Property

All content on our website, including but not limited to text, images, logos, product descriptions, and design, is the intellectual property of Rare Ritual Labs or its licensors and is protected by applicable copyright and trademark law.

You may not reproduce, distribute, modify, or use any content from our website for commercial purposes without our prior written consent. You may share or link to our content for personal, non-commercial purposes provided you credit Rare Ritual Labs as the source.

11. Limitation of Liability

To the fullest extent permitted by South African law, Rare Ritual Labs will not be liable for:

  1. Indirect, incidental, or consequential losses arising from your use of our website or products
  2. Loss of profits, revenue, or data
  3. Any losses arising from circumstances beyond our reasonable control

Our total liability to you for any claim arising from these terms or your use of our products will not exceed the total amount paid by you for the relevant products in the 12 months preceding the claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under South African law, including the CPA.

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or in connection with these terms will be subject to the jurisdiction of the South African courts.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. The updated version will be posted on our website with a revised effective date. By continuing to use our website or purchase products after we post changes, you accept the updated terms.
